PaintballStoreOnline.com is located in Tampa, Florida. Our online store is mainly website based, and customer service is available to you seven days a week. The Orbital Paintball field is located 1 Mile North of CR 579 on Hwy 301, in Thonotosassa, Florida. You have the option of picking up your merchandise at our field on our open days, rather than having it shipped. Ground shipping charges for certain items may still apply (see
ORDERING/SHIPPING). We are open every Saturday & Sunday: 9:00am - 4:00pm.

Products sold by PaintballStoreOnline.com, a division of Orbital Paintball Inc., carry a manufacturer’s warranty. Warranty length varies by manufacturer. For information on a specific product, please call our customer service or contact the manufacturer direct - phone/address listings below.

PaintballStoreOnline.com is strictly a retail store. Reputable companies manufacture the products that we sell. PaintballStoreOnline.com does not inspect or test the individual items before shipping. Therefore, PaintballStoreOnline.com does not provide warranty service for any of the products sold on its website. Warranties, if any, for those products that we sell are provided and serviced by the manufacturer of that particular product. PaintballStoreOnline.com does not warrant that any of the products sold perform as advertised by the manufacturers, their agents or by any other form of advertisement.

Before you purchase any product from our company, please check to make sure you completely understand the conditions of that manufacturer's warranty policy. Any and all warranty, repair or faulty equipment questions must be directed to the manufacturer of the item in question. Your after-purchase needs and concerns can easily be resolved by the manufacturer of that particular product. Neither PaintballStoreOnline.com or the manufacturer is responsible for the shipping costs of any item requiring warranty service.

Refurbished Equipment Warranty:
All refurbished equipment that you purchase from PaintballStoreOnline.com is backed by a manufacturer's warranty. PaintballStoreOnline.com warrants that the refurbished equipment it sells will be free from defects in operational characteristics. The equipment is tested before it is offered for sale on our web site. Refurbished equipment may not necessarily be packaged in the original carton and such equipment is subject to cosmetic blemishes. This warranty applies to purchases made in the United States or Canada.

Merchandise purchased for the purpose of resale is not covered under this warranty, nor is this warranty transferable. This limited warranty covers normal use. The limited warranty does not cover damage resulting from improper packing during shipment, damage during shipment, damage caused by failure due to usage not in accordance with product instructions, or failure to perform required preventive maintenance. Warranty coverage will not apply in the event the serial number has been removed, altered or defaced. During the warranty period, PaintballStoreOnline.com will, at its option, repair or replace defective or damaged products returned to our warehouse, or refund the amount you paid for the product less depreciation upon its return to our facility. Requests for warranty service can be made by calling our Customer Support Team. When calling this team, have the following information available: order number, serial number, a description of the problem and the type of equipment. Valid proof of the date of original consumer purchase, including the serial number of the product, may be required before warranty service is provided. If our technician determines that a warranted product is defective and that either a repair is necessary or that a replacement product is required, you will be given a Return Authorization ("R.A.") number for the return of the defective product. This number must be clearly marked on the outside of the original packaging, prior to return. You are financially responsible for the return of the defective product. The defective product must be received in our warehouse within fifteen (15) days in order to allow for one hundred (100) percent credit back to you. The defective product should be shipped to us prepaid and insured using the original box and packing materials (or equivalent packaging). Shipping and handling costs of the repaired or replaced product will be your responsibility. PaintballStoreOnline.com refurbishes its equipment from parts and components that are new or equivalent to new in accordance with industry-standard practices.

PaintballStoreOnline.com owns all parts removed from repaired products. PaintballStoreOnline.com uses new and reconditioned parts made by various manufacturers in performing warranty repairs and refurbishing products. If PaintballStoreOnline.com repairs or replaces a product, its warranty term is not extended. Under no circumstance will PaintballStoreOnline.com be responsible for any incidental or consequential damages, which may occur during the use of PaintballStoreOnline.com’s refurbished equipment, or as a result of the product's failure to perform. In all cases, the customer's sole remedy for a product failure is limited to the repair or replacement of the product.

Paintball Warranty:
While in transit, there are occasions when the shipper might subject your package to undue stress which could result in paintball breakage, we cannot guarantee against all breakage. In the unlikely event that you receive paintballs that have excessive damage, please retain all of the original shipping boxes, and packing material, so that you can file a claim with the shipper. They need to see that we did, in fact, package the paintballs according to their expectations.

Once a representative from UPS has looked at the package, they will contact us. Upon receipt of the claims payment from them, we will send you a replacement or credit as per your request. We recommend that paintballs be shipped via UPS regular ground. Shipping paintballs via air transport increases the risk of damage. PaintballStoreOnline.com is not responsible for any ball breaks that may occur during shipping.
Generally, we have everything in stock that is listed on our web site. Of course, there are those rare occasions when we may be out-of-stock on a particular color of paintball. Therefore, we reserve the right to substitute a different color of paintball of the same, or better, quality from the same manufacturer if the order that you have placed over the internet includes paintballs that are out of stock. If you would like to order an out-of-stock paintball color for delivery when it arrives, you will need to contact us and place a phone order. When ordering paintballs online, we assume that you are intending to shoot them in the near future; therefore, we offer this service to enable you to have paintballs delivered to you in a timely manner. Air shipping is not available on paintballs, the cost is too much.

ORDERING / SHIPPING
Refused orders will be subject to a $20 handling fee. Most orders are shipped within 48 hours. If any of the items you order are on backorder, we will notify you by email. See also RETURNS . C.O.D. cannot be used as a shipping method for Next day and 2nd Day shipments.

Shipping:
Expected ground shipping times once your package leaves our shipping center (specific timeframe not guaranteed by UPS) are shown on MAP above. We are unable to ship via UPS Next Day or 2nd Day Air, any air tank shipments due to new federal regulations.

Freight/Back Orders :  All freight and handling charges are calculated and added to the invoice total. PaintballStoreOnline.com will ship back orders automatically as products become available and the buyer will be liable for payment on any back orders unless PaintballStoreOnline.com receives buyer's cancellation prior to PaintballStoreOnline.com's shipment of same.

Customer Pick-Up Option:
Applies to our Tampa Field, Orbital Paintball Inc.  Pick-up can be made Saturday or Sunday at the field, please call (813)-298-0337 to verify pick up date. Ground shipping charges will still apply to certain items when using this option. Checkout cart will reflect savings. (Paintballs are not eligible for this discount.)

Free Shipping Offer:
We are currently offering FREE shipping for all orders over $200 (Excludes heavy and/or bulky items). These may include some gun packages or paintballs. To find out if your order qualifies for FREE SHIPPING just add your items to the shopping cart and begin the check out process. If you see a shipping charge then you know that one or more of your items do not qualify for this special offer. Good for internet orders only.  COD's, APO / FPO, international, and phone orders are excluded. To get free UPS ground shipping, you must use the free UPS ground shipping method.  If you do not use the appropriate method, no refund will be granted.  Refused orders will be subject to a $20 handling fee - so order accordingly.  If your order total is not over $200 before tax and/or shipping and you chose the free shipping method, we will adjust your shipping charges. (Paintballs are not eligible for this discount.)

Holiday Shipping:
As we get closer to Dec. 25th, UPS and FEDEX do not guarantee shipping times for any packages, including next day and 2nd day.

BUYER'S AGREEMENT
The buyer agrees to pay any and all collection and/or recovery costs, attorneys fees if the buyer's credit card company/payment method refuses (for whatever reason) to pay the charges to PaintballStoreOnline.com. The buyer agrees to provide sufficient, reliable, and accurate information to PaintballStoreOnline.com - name, address, e-mail address, and telephone number - for PaintballStoreOnline.com to be able to verify the legitimacy of the transaction; the buyer agrees to bring any legal action against PaintballStoreOnline.com only. The buyer represents that he or she is over the age of eighteen (18).

CLAIMS
PaintballStoreOnline.com inspects, and weighs, each order to insure its accuracy before shipping. Claims of shortages or damaged items must be reported (by filling in the CONTACT form and select RETURNS from the drop down menu) within 48 hours of delivery of the order. After 48 hours no claims will be honored. We do not honor oral claims, so please do not call us, as this will only delay our investigation. You, the customer, must retain the original shipping carton and packaging materials in the event that it becomes necessary to file a UPS missing item or damage claim. Title of merchandise passes to the buyer upon delivery by common carrier. Damaged or lost goods are the sole responsibility of the common carrier/transportation company. Buyer should immediately file claims for damaged or lost goods with the common carrier/transportation company.

RETURNS / RMA#
PaintballStoreOnline.com accepts returns on merchandise in accordance with the following:
All merchandise returns require PaintballStoreOnline.com's pre-approval and a return authorization number, an (RMA#) - obtained by filling in the CONTACT form and select RETURNS from the drop down menu.PaintballStoreOnline.com will refuse any returns received without an authorization number.

All returns must include a copy of the invoice and a letter of explanation. All merchandise returned for exchange must be within ten (10) days after the invoice date and must be in new, resalable condition, and contain all original packaging. Paint, sale or discounted merchandise is non-returnable. A 25% re-stocking fee at invoiced prices is applied to all returned merchandise unless buyer makes a direct exchange. Items shipped by PaintballStoreOnline.com in error are not subject to restocking fees. Buyer forfeits all unused credit one (1) year after credit balance is established. If you have a damaged shipment, all products must be returned, processed and verified as damaged for proper UPS claim handling. Refunds or replacements cannot be given without submitting a claim with UPS. Any claim of missing items or damaged goods must be made by calling our customer service within 48 hours of receipt.

Conditions:
You may return most merchandise within 30 days of receipt of your order. Certain products may not be returned for any reason. These items include: paintballs, grenades and clothing. Additionally, items that are missing parts or are damaged (broken, cracked, soiled, etc) can not be returned. Merchandise must be returned complete with all the original packaging, manual(s), blank warranty cards, miscellaneous parts and accessories. Incomplete returns will be subject to additional return charges as so determined by those items that are missing from the return.

All free items must be returned together with the purchased items in order to receive a refund. All products returned will be subject to a 25% restocking and/or reconditioning fee. No returns will be accepted after 30 days from the date you receive your order. You must obtain a Return Authorization (RMA) number from us before you can send any item back to our warehouse. If you attempt to send any package to our warehouse without the RMA number plainly visible on the outside of the package, that package will be returned to you. Shipping charges are not refundable; specially ordered or custom-made items are not refundable. No closeout items or specially discounted sales are refundable.

The customer must sign the front of their invoice where indicated and return the invoice along with the items or the return cannot be processed.

Process for Returns:
If you meet the conditions set forth above and wish to return an item(s) you must follow these directions:
1. First, fill in and submit the CONTACT form and select RETURNS from the drop down menu. Include your order number, the item you want to return and the reason for the return. PaintballStoreOnline.com will not take returns over the telephone; we require a Return Request Form for our audit trail. Not following this procedure will delay your return.
2. PaintballStoreOnline.com will email you with a Return Authorization (RMA) number usually within 48 hours.
3. Please write your authorization number on the outside of the box you are returning, next to your return address. Without a visible RA number on the outside of the return box, our receiving department will not accept the package and it will be returned to you.
4. The customer is responsible for shipping costs associated with merchandise being returned.

Refunds for Returns:
1. After receiving your authorized return PaintballStoreOnline.com will inspect the returned item(s) to ensure that the conditions set forth above are met.
2. If the item(s) you are authorized to return do not meet the conditions set forth above, PaintballStoreOnline.com will return the item(s) to you at your cost.
3. If all the conditions are met, PaintballStoreOnline.com will refund you the amount of the item(s) returned minus any applicable return fee. The refund will be issued by the same method you used for payment. Please allow a week from the time we receive your return for the refund to appear on your credit card.
4. PaintballStoreOnline.com will not refund you for merchandise that has been damaged in shipping due to incorrect packaging by the customer.

CANCELLATIONS
If, after placing an order with PaintballStoreOnline.com you decide that you do not want the order, you must cancel the order before we ship it by using our Cancel Order Form (do this by filling in the CONTACT form and select CANCEL ORDER from the drop down menu). If you cancel your order after PaintballStoreOnline.com has shipped it, you are still responsible for the costs associated with shipping it. Refusing to accept the delivery of your PaintballStoreOnline.com order does not constitute a cancellation of that order. You are still responsible for all costs associated with shipping the order to you. The refund that you will receive is only for the merchandise returned to us.

PAYMENT TERMS
PaintballStoreOnline.com accepts Visa, MasterCard, Discover, PAYPAL, Money Orders and Cashiers Checks. Credit Card orders are typically processed within 24 hours after they are placed. Money Orders and Cashiers checks will be processed when received.

If a buyer stops payment on merchandise already shipped, PaintballStoreOnline.com will place buyer on NO SHIP status and will charge buyer a $35.00 returned check/payment fee. Buyer agrees to pay all costs of collection, including reasonable attorney's fees, incurred by PaintballStoreOnline.com as a result of buyer's failure to make timely payment to PaintballStoreOnline.com.

We make every attempt to be sure that the information provided on PaintballStoreOnline.com's website is accurate and correct, but occasionally an error can get by. We are not liable for any product informational typographical errors on the website. If you find an error on the website please report it to us for immediate correction.

In the event a PaintballStoreOnline.com product is listed at an incorrect price due to typographical error or error in pricing information, PaintballStoreOnline.com shall have the right to refuse or cancel any orders placed at the incorrect price. PaintballStoreOnline.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, PaintballStoreOnline.com shall issue a credit to your credit card account in the amount of the incorrect price.

International customers are responsible for paying tariffs, duties, custom charges and/or any fees imposed by their country for allowing the purchased products to enter. International customers are also responsible for laws governing the purchase, possession and/or use of paintball equipment in their country. PaintballStoreOnline.com will not refund or accept a return from an International customer due to the restrictions placed upon such equipment by their country.

PaintballStoreOnline.com reserves the right to change prices and terms without notice. All prices and products are subject to availability. Buyers shall not use any Orbital Paintball Inc. or PaintballStoreOnline.com logos, trademarks, photographs, artwork, or copy in any advertising media without Orbital Paintball Inc. or PaintballStoreOnline.com's prior written consent. Buyer may only use logos, trademarks, photographs, artwork and copy provided Orbital Paintball Inc. or PaintballStoreOnline.com. Orbital Paintball Inc. or PaintballStoreOnline.com must approve in writing in advance the method, means, appearance, and medium for any use of our logos, trademarks, photographs, artwork, and copy.

Indemnity.
Dealer shall indemnify, defend, and hold harmless Orbital Paintball Inc. or PaintballStoreOnline.com from and against any and all claims, loss, and costs including reasonable attorneys' fees, (a) arising out of or in any way related to buyer's action as buyer hereunder and (b) any claims, demands, liabilities or expenses, including reasonable attorneys' fees, incurred by Orbital Paintball Inc. or PaintballStoreOnline.com arising out of or based upon the operation or use of the Products with any hardware, products, programs or data not supplied or approved in writing by Orbital Paintball Inc. or PaintballStoreOnline.com or the modification of the Products by buyer or anyone to whom buyer sells the Products.

Attorneys' Fees.
In the event of any legal action, arbitration or other proceeding brought by either party for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, then the prevailing party shall be entitled to recover reasonable attorneys' fees and other costs incurred, in addition to any other relief to which it may be entitled.

Arbitration.
If a dispute arises out of or relates to this Agreement, or the breach thereof, the parties agree to binding arbitration to resolve such disputes as follows: The party requesting arbitration shall do so by written notice to the other party/parties. The arbitration shall be held in the City of Lakeland, County of Polk, State of Florida, and conducted in accordance with the rules of the American Arbitration Association, before a panel of three arbitrators selected in accordance therewith. The parties will make all reasonable attempts to facilitate an efficient and effective arbitration process and will abide by and perform any award rendered by the arbitrator. The parties agree that the award may be entered as a judgment in any court having jurisdiction, or application may be made to such court for a judicial acceptance of the award and an order of enforcement. Nothing herein shall limit the right of any party to this Agreement to seek judicial equitable relief, or other equitable relief available to it under applicable statutory and/or case law including, but not limited to, injunctive relief.
